2. Description of Service

HVAC Estimators is a community-powered platform that enables homeowners and HVAC contractors to:

• Search and compare real HVAC installation and replacement prices by ZIP code.
• Submit their own HVAC project costs, including equipment specifications, labor, and material costs.
• Compare equipment brands by average cost and efficiency ratings.
• Access a REST API (for contractors) to submit pricing data programmatically.

The Service is provided free of charge. We reserve the right to modify, suspend, or discontinue any part of the Service at any time without notice.

3. User Accounts

• You may need to create an account to submit pricing data or access certain features.
• You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
• You must provide accurate and truthful information when creating your account.
• You must notify us immediately if you suspect unauthorized access to your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. User-Submitted Content

a) Content Ownership

You retain ownership of the HVAC pricing data and information you submit. By submitting content to the Service, you grant HVAC Estimators a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to use, display, reproduce, modify, and distribute your submitted data in connection with providing and improving the Service.

b) Content Standards

When submitting data, you agree to:

• Accuracy: Submit only truthful pricing data based on actual HVAC projects you have completed or paid for. Do not submit fabricated, misleading, or speculative pricing.
• No Spam: Do not submit duplicate, promotional, or irrelevant content.
• No Personal Information of Others: Do not include personally identifiable information (names, addresses, phone numbers) of other individuals in your submissions.
• Compliance: Do not submit content that violates any applicable laws or regulations.

c) Content Removal

We reserve the right to remove or modify any submitted content at our sole discretion, including content that we believe is inaccurate, misleading, abusive, or in violation of these Terms.

5. API Access

Contractors may generate API keys to submit data programmatically. By using the API, you agree to:

• Keep your API key confidential and not share it with unauthorized parties.
• Use the API only for legitimate HVAC pricing submissions.
• Comply with rate limits (maximum 10 submissions per 24-hour period).
• Not attempt to reverse engineer, exploit, or overload the API.

We may revoke API access at any time for violations of these Terms.

6. Accuracy Disclaimer

HVAC pricing data displayed on the Service is user-submitted and community-sourced. We do not independently verify the accuracy of any submission. Pricing varies significantly based on location, equipment specifications, installation complexity, contractor, time of year, and other factors.

The information on this Service is for informational and comparison purposes only and should not be construed as:

• A professional estimate or quote for HVAC work.
• A guarantee of pricing in your area.
• Professional HVAC, engineering, or financial advice.

Always obtain multiple quotes from licensed HVAC contractors before making purchasing decisions.

7. Prohibited Uses

You agree not to:

• Use the Service for any unlawful purpose.
• Scrape, harvest, or systematically download data from the Service without our written consent.
• Attempt to gain unauthorized access to other users' accounts or our systems.
• Use automated tools (bots, scrapers) to access the Service beyond the provided API.
• Interfere with or disrupt the Service or servers connected to the Service.
• Impersonate another person or entity.
• Use the Service to collect or store personal data of other users without their consent.

8. Intellectual Property

The Service, including its design, layout, features, code, and branding (excluding user-submitted content), is the property of HVAC Estimators and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written consent.

9. Disclaimer of Warranties

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HVAC ESTIMATORS AND ITS OPERATORS, AFFILIATES, AND CONTRIBUTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO DAMAGES FROM RELIANCE ON PRICING DATA, LOSS OF PROFITS, OR LOSS OF DATA. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US (IF ANY) IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless HVAC Estimators from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your submissions, or your violation of these Terms.
